ORDINANCE NO. 10043 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 4055 CUMMINGS ROAD, BEING ON THE NORTHEAST LINE OF CUMMINGS ROAD SOUTHEAST OF CUMMINGS HIGHWAY, AND ON THE SOUTHWEST LINE OF CUMMINGS HIGHWAY SOUTHEAST OF CUMMINGS ROAD FROM R-1 RESIDENTIAL ZONE AND R-2 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE AND R-4 SPECIAL ZONE. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 4055 Cummings Road, being on the northeast line of Cummings Road southeast of Cummings Highway, and on the southwest line of Cummings Highway southeast of Cummings Road. An unplatted tract, being part of the properties described in deed book L, volume 12, page 664, ROHC, deed book L, volume 12, page 665, ROHC, deed book T, volume 17, page 629, ROHC, deed book T, volume 17, page 630, ROHC, deed book C, volume 22, page 627, ROHC, deed book F, volume 22, page 439, ROHC, and deed book C, volume 23, page 392, ROHC; and being all of Tract 2 as shown on a boundary survey of a portion of the Will Cummings property in Sections 11 and 14, Township 2, Range 5, West of the Basis Line, Ocoee District, drawing no. 7463-20-93B by Betts Engineering Associates, Inc., dated September 12, 1990, excepting from said Tract 2 all of Tract 1, Final Plat, Asbury Center-Lookout Valley Subdivision, as shown by plat of record in plat book 52, page 97-1, ROHC, the remainder of said Tract 2 to be zoned as two tracts. To be zoned C-2: A strip of land off the northeast side of said Tract 2 being 200 feet in width and lying along the southwest line of Cummings Highway. To be zoned R-4: All of said Tract 2, with the exception of that portion to be zoned C-2. Tax Map No. 153-27 (part). from R-1 Residential Zone and R-2 Residential Zone to C-2 Convenience Commercial Zone and R-4 Special Zone. SECTION 2. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as required by law.
